Intellectual Property & Operator Notice

The Sophion platform, brand, and all associated intellectual property (including source code, design assets, documentation, trademarks, and the sophion.org domain) are owned by David Stoneand his designated heirs or transferees. All rights reserved.

Sophion is operated and managed within the United Kingdom by David Stone, trading as Sophion.org (sole trader). David Stone is the UK data controller and point of contact for all service, commercial, and customer matters within the United Kingdom.

1. Acceptance of Terms

By accessing or using the Sophion platform ("Service", "Sophion"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

The Service is owned and operated by David Stone, trading as Sophion.org ("we", "us", "our"), within the United Kingdom.

2. Description of Service

Sophion is an AI-powered educational document personalisation platform. The Service allows users to upload educational documents, build learning personality profiles through assessments, and receive personalised "For You" learning sections generated by artificial intelligence.

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate, complete information and to keep your credentials secure. You are responsible for all activity under your account. You must be at least 13 years of age to use the Service. Users under 18 may require parental consent as specified by applicable law.

4. User Content

You retain ownership of all documents and content you upload ("User Content"). By uploading User Content, you grant us a limited, non-exclusive licence to process, analyse, and personalise your content solely for the purpose of providing the Service. We do not claim ownership of your documents.

You represent that you have the right to upload and process any content you submit, and that your content does not infringe upon the intellectual property rights of any third party.

5. AI-Generated Content

The Service generates personalised learning content using artificial intelligence. AI-generated "For You" sections are provided for educational purposes only. While we strive for accuracy and relevance, AI-generated content may contain errors or inaccuracies. You should not rely solely on AI-generated content for critical decisions.

6. Credits and Payments

Document processing requires credits, which can be purchased through the platform. Credit purchases are processed by Stripe. All purchases are final and non-refundable unless required by applicable law. We reserve the right to modify pricing at any time with reasonable notice.

7. Content Moderation

All uploaded documents undergo automated content moderation. We reserve the right to reject or remove content that violates our community guidelines, including but not limited to illegal content, explicit material, or content promoting harm. Moderation decisions may be automated.

8. Prohibited Uses

You agree not to:

  • Upload content that infringes intellectual property rights
  • Attempt to reverse-engineer the AI personalisation engine
  • Use the Service for any unlawful purpose
  • Circumvent rate limits or security measures
  • Share your account credentials with others
  • Upload malicious files or attempt to exploit the system

9. Intellectual Property

The Sophion platform, including its design, algorithms, source code, documentation, branding, trademarks, and the sophion.org domain, is the intellectual property of David Stone(and his designated heirs or transferees). All rights reserved. The LTSC framework (Learn, Try, Stay, Care) and associated methodologies are proprietary.

Nothing in these Terms transfers any intellectual-property rights to you or to any third party other than as expressly stated.

10. Limitation of Liability

To the maximum extent permitted by law, David Stone (trading as Sophion.org) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the preceding 12 months.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases, but these Terms survive as applicable.

12. Marketplace Purchases

The following additional terms apply to purchases made through the Sophion Author Marketplace:

12.1 Digital Content Licence. When you purchase a title through the Marketplace, you receive a non-exclusive, non-transferable, personal licence to access and read the digital content. You do not acquire ownership of the underlying work. All intellectual property rights remain with the author.

12.2 Verified Purchase Reviews. Only users who have completed a purchase may leave a review. Reviews must be honest, relevant, and comply with our community standards. We reserve the right to flag or remove reviews that violate these standards or contain abusive, misleading, or irrelevant content. Authors may respond to reviews once per review.

12.3 Cooling-Off Waiver. As digital content is delivered immediately upon purchase, you acknowledge and consent to waive the 14-day cooling-off period provided under the Consumer Contracts Regulations 2013 at the point of purchase. Refunds are handled in accordance with our refund policy.

12.4 Pricing. All prices are displayed in GBP and include VAT where applicable. Prices may change at any time, but changes do not affect purchases already completed.

12.5 Author Responsibilities. Authors are responsible for the accuracy and legality of content they publish through the Marketplace. Sophion.org acts as an intermediary platform and does not endorse or guarantee the quality, accuracy, or completeness of any Marketplace listing.

12.6 Commission and Payments. Sophion.org retains a commission on each sale as disclosed to authors during onboarding. Author payouts are processed via Stripe Connect in accordance with the Author Agreement and self-billing arrangements.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
